Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of KinGuardian, a caregiving coordination platform (“Service”) operated at kinguardian.app (“we,” “our,” or “us”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use KinGuardian.

1. Service Description

KinGuardian is a caregiving coordination platform designed to help family caregivers and care teams organize and manage health-related information for the people in their care. The Service includes:

  • Secure storage and organization of medical documents, lab results, and imaging reports.
  • AI-assisted document analysis to surface clinically relevant information and critical findings.
  • Medication tracking, appointment scheduling, and task management for care teams.
  • Multi-caregiver team coordination with role-based access (co-caregiver, viewer, physician, family guest).
  • Inbound document ingestion via email and SMS.
  • SMS and email notifications for reminders, alerts, and care coordination.

2. Account Responsibilities

You must be at least 18 years old to create a KinGuardian account. By registering, you represent that all information you provide is accurate and that you have the legal authority to manage the health information of any care recipient you add to the platform.

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately at support@kinguardian.app if you suspect unauthorized access to your account.
  • You may not share your account with others or create accounts on behalf of third parties without their consent.
  • You agree not to use the Service for any unlawful purpose or in any way that violates these Terms.

3. SMS Program Terms

Program Name: KinGuardian Alerts

KinGuardian sends SMS notifications to caregivers who have opted in to receive alerts about the people in their care. These messages may include medication refill reminders, appointment reminders, critical lab result alerts, prior authorization expiry notices, and care team activity updates.

How to Enroll

You enroll in the KinGuardian SMS program by providing your mobile phone number in your account settings and enabling SMS notifications. By doing so, you consent to receive automated text messages from KinGuardian at the number you provide.

Message Frequency

Message frequency varies based on your care team activity and the notification settings you configure. You may receive multiple messages per day during active care events. You can adjust notification preferences at any time in Settings.

Message & Data Rates

Message and data rates may apply. KinGuardian does not charge for SMS messages, but your mobile carrier may charge for messages sent to or received from us. Check your carrier plan for details.

Opt-Out Instructions

To stop receiving SMS messages from KinGuardian at any time, reply STOP to any message we send you. After opting out, you will receive a single confirmation message and no further messages will be sent to that number unless you re-enroll. You may also disable SMS notifications from within your account Settings.

For help with the SMS program, reply HELP to any message, or contact us at support@kinguardian.app. We will respond within one business day.

Supported Carriers

KinGuardian SMS is available on major US carriers including AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, and others. Carrier support may vary. KinGuardian is not liable for delayed or undelivered messages caused by your carrier.

Inbound MMS

If your carrier plan supports MMS, you may send medical documents and images to your care recipient’s assigned KinGuardian phone number. Inbound MMS messages are processed and stored as documents in your care recipient’s record and are subject to the same privacy protections described in our Privacy Policy.

4. Healthcare Disclaimer

Important: KinGuardian is not a medical device or clinical service.

The information, alerts, and AI-generated analyses provided by KinGuardian are for organizational and informational purposes only. They do not constitute medical advice, diagnosis, or treatment.

  • Always consult a qualified healthcare professional for medical decisions.
  • AI-generated critical findings and document analysis are assistive tools only. They may contain errors, omissions, or misinterpretations.
  • Do not delay seeking professional medical attention based on information from KinGuardian.
  • KinGuardian is not a HIPAA Business Associate by default. If you require a Business Associate Agreement, please contact us at support@kinguardian.app.
  • In an emergency, call 911 or your local emergency services immediately.

5. Acceptable Use

You agree not to:

  • Upload content that is illegal, fraudulent, abusive, or that infringes on third-party rights.
  • Attempt to gain unauthorized access to any part of the Service or another user’s data.
  • Use the Service to store or transmit malware, viruses, or other harmful code.
  • Scrape, crawl, or otherwise extract data from the Service in bulk without our written consent.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use the Service in any manner that could damage, disable, or impair its infrastructure.

We reserve the right to suspend or terminate accounts that violate these rules, with or without prior notice.

6. Intellectual Property

The KinGuardian platform, including its design, code, trademarks, and AI models, is owned by KinGuardian and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service.

You retain full ownership of all content and data you upload to KinGuardian. By uploading content, you grant us a limited, non-exclusive license to store, process, and display your content solely as necessary to provide the Service to you.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
  • In no event shall KinGuardian, its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or goodwill, arising out of or related to your use of the Service.
  • Our total aggregate liability to you for any claims arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid to KinGuardian in the twelve months preceding the claim, or (b) one hundred US dollars ($100).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

8. Indemnification

You agree to indemnify, defend, and hold harmless KinGuardian and its officers, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

9. Termination

You may terminate your account at any time by contacting us at support@kinguardian.app. We reserve the right to suspend or terminate your access to the Service at our discretion, including for violations of these Terms. Upon termination, your right to use the Service ceases immediately and your data will be handled as described in our Privacy Policy.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable.

11. Changes to These Terms

We may revise these Terms at any time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you by email or in-app notice. Your continued use of KinGuardian after revised Terms take effect constitutes acceptance of the changes.
